1. Scope and parties

  1. These terms apply to the use of the WordPress plugins Cursora (free plugin) and Cursora Pro (add-on), including updates and support. Provider and licensor is Webagentur Hochmeir e.U., owner Jonathan Hochmeir, Moorweg 7, 4845 Rutzenmoos, Austria, email support@cursora.webhoch.com, company register number FN 597527 t, Regional Court Wels (“webhoch”, “we”).
  2. We sell Cursora Pro through Freemius, Inc. as our reseller (merchant of record). You conclude the purchase contract, including payment, invoice and VAT, with Freemius under its terms. These terms govern the use of the software, the license, updates and support between you and us.
  3. “Consumers” are customers within the meaning of the Austrian Consumer Protection Act (KSchG); all others are “businesses”.
  4. Deviating terms of customers only apply if we expressly agree to them.

2. Free plugin Cursora

Cursora is free and licensed under the GNU General Public License, version 2 or later (GPLv2+). The terms of the GPL apply. We do not promise support with specific response times for the free plugin; we answer questions where we can.

3. License for Cursora Pro

  1. With your purchase you receive, for the term of the subscription, a license key for the number of websites in your plan (Personal: 1, Business: 5, Agency: 50). A website is one WordPress installation under one domain; installations on localhost do not count. You can move a license slot to another website at any time.
  2. Like WordPress, the code of Cursora Pro is licensed under the GPLv2+. The license key governs access to downloads, updates and support during the term; your rights under the GPL remain unaffected.
  3. The names and trademarks “Cursora” and “webhoch” are not part of the GPL license.
  4. Cursora Pro requires a current version of the free Cursora plugin.

4. Free trial

Cursora Pro can be tried free of charge for 14 days without a payment method. The trial ends automatically; without a purchase, nothing is charged.

5. Prices, term and renewal

  1. The prices shown on cursora.webhoch.com and in the checkout at the time of the order apply. Freemius adds VAT in the checkout depending on your country.
  2. The subscription runs for one year from the purchase and renews for another year unless canceled before it ends. Freemius reminds you by email before each renewal. You can cancel at any time with effect from the end of the term – in your Freemius customer account or by email to support@cursora.webhoch.com.
  3. After expiry or cancellation, Cursora Pro keeps working in the last installed version; updates and support end.

6. 30-day money-back guarantee

Within 30 days of your purchase, we refund the full price on request, no questions asked. An email to support@cursora.webhoch.com is enough; the refund is made through Freemius. The license ends with the refund. Your statutory rights, such as the right of withdrawal, remain unaffected.

7. Updates and support

  1. During the term, we provide updates with bug fixes and security and compatibility adjustments.
  2. Support is provided by email to support@cursora.webhoch.com, usually within two working days (Monday to Friday, except Austrian public holidays). It covers questions about setting up Cursora and errors in Cursora, but not adjustments to themes, plugins or code of other vendors.

8. Your obligations

You only use images you hold the necessary rights to, keep WordPress and PHP at a supported version and check changes before using them on a live website. You are responsible for the content and the accessibility of your website.

9. Warranty

  1. For consumers, the statutory warranty for digital services under the Austrian Consumer Warranty Act (VGG) applies, including the updates required to keep Cursora in conformity with the contract.
  2. For businesses, the warranty is excluded as far as legally permitted.
  3. Cursora works with a great many, but not with all themes, plugins and browsers; known limits are described in the docs.

10. Liability

  1. We are liable for damage caused intentionally or by gross negligence. For slight negligence, we are only liable for personal injury.
  2. Toward businesses, liability for lost profits, consequential damage and data loss is excluded and liability is limited to the license fees of the last twelve months, as far as legally permitted.
  3. Mandatory liability, for example under the Product Liability Act, remains unaffected.

11. Privacy and withdrawal

How we handle personal data is described in the privacy policy. Consumers have a statutory right of withdrawal; details and its expiry for digital content are described on the right of withdrawal page.

12. Applicable law and jurisdiction

  1. Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods and the rules of private international law. Consumers habitually resident in another country keep the mandatory protection of that country’s law.
  2. The place of jurisdiction for businesses is the court with subject-matter and local jurisdiction for 4845 Rutzenmoos. For consumers, the statutory jurisdiction under § 14 KSchG applies.

13. Changes and final provisions

  1. Changed terms apply to new purchases and from the next renewal; we inform subscribers by email beforehand.
  2. If a provision is invalid, the remaining provisions stay valid.
